1. Agreement to Terms

By accessing our website and using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access the service.

2. Description of Service

Pulse is a service provided by Brentmoor, Inc. that provides AI-powered social media management tools for businesses. We reserve the right to modify, suspend, or discontinue the service at any time.

3. User Accounts

To access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Subscription Plans and Billing

Pulse offers a free tier and paid subscription plans (Starter, Pro, and Agency). By subscribing to a paid plan, you agree to the following:

• Recurring Billing: Paid plans are billed monthly on a recurring basis. By subscribing, you authorize us to charge your payment method on each billing cycle until you cancel.
• Free Trial: New subscribers may be eligible for a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.
• Payment Processing: All payments are processed securely by Stripe. We do not store your payment card or bank account details. Your use of Stripe is subject to the Stripe Services Agreement.
• Price Changes: We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle following the notice.

5. Cancellation and Refunds

• Cancellation: You may cancel your subscription at any time through the app settings or by contacting us. When you cancel, you retain access to your paid plan features through the end of your current billing period.
• Downgrade: After your billing period ends, your account will revert to the free tier. Features and usage limits associated with your paid plan will no longer be available.
• Refunds: Subscription fees are non-refundable except where required by applicable law.

6. Usage Limits

Each subscription tier includes specific usage limits for features such as the number of connected pages, AI replies, AI captions, and AI videos per month. If you exceed your plan's limits, you will need to upgrade to a higher tier to continue using those features. Usage limits reset at the start of each billing period.

7. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
• Use the AI features to generate spam, harassing, misleading, or deceptive content.
• Attempt to circumvent usage limits, access controls, or security measures.
• Resell or redistribute the service without our written permission.
• Interfere with or disrupt the integrity or performance of the service.

8. Intellectual Property

You retain ownership of all content you create, upload, or publish through Pulse. By using the service, you grant us a limited license to process your content as necessary to provide the service (e.g., generating AI replies, publishing posts, displaying analytics). We do not claim ownership of your content.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that AI-generated replies, captions, or classifications will be accurate, appropriate, or error-free. You are responsible for reviewing AI-generated content before it is sent on your behalf, or for the content sent automatically if you enable autopilot mode.

10. Limitation of Liability

To the fullest extent permitted by law, Brentmoor, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the service. Our total liability for any claim arising from these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the service at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately. Any active subscription will be cancelled and no refund will be issued for the remaining billing period, except where required by law.

12. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of Pulse after any changes constitutes your acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
